Terms of Service, Privacy Policy, and Store Policies
Welcome to Our Online Store
St. Lawrence Pools is excited to launch our online store. In partnership with HotTubGO, our initial focus will be on hot tub chemicals and accessories. St. Lawrence Pools was founded in 1971 and now has stores in Cobourg, Belleville, Kingston, Brockville, and Kemptville (seasonal).
1. Overview and Acceptance
This website (the “Site”) is owned and operated by St. Lawrence Pools (1995) Limited, including its related brands and services, such as HotTubGO (collectively, “we”, “us”, or “our”). The Site provides an ecommerce platform through which we offer goods and services (the “Services”).
By accessing or using the Site, purchasing goods, or using any Services, you agree to be bound by these Terms, together with any policies referenced herein, including our Privacy Policy, Shipping Policy, and Returns Policy (collectively, the “Terms”). If you do not agree, you must stop using the Site or Services. Continued use constitutes your acceptance of any updates.
We reserve the right to update or replace these Terms at any time. Changes take effect upon posting.
2. Eligibility and Acceptable Use
You represent that you are at least 18 years of age (the age of majority in Ontario) or that you have obtained the consent of a legal guardian. Our online store currently serves customers within Ontario only. You agree to use the Site only for lawful purposes and in compliance with all applicable laws. Any misuse, including fraudulent, unlawful, or abusive conduct, may result in suspension or termination of access without notice.
3. Accuracy of Information
All content on the Site is provided for general information only. We do not warrant that information is correct, complete, or up to date. Product descriptions, images, pricing, availability, promotions, and shipping details may contain errors or omissions. We reserve the right to correct inaccuracies or cancel orders at any time, including after order submission, and disclaim liability to the fullest extent permitted by law.
4. Accounts and User Content
If you create an account, you are responsible for maintaining its confidentiality and accuracy. You must notify us immediately of unauthorized use.
You may submit reviews or comments (“User Content”). You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute it in connection with our Services. We may remove User Content at our discretion if it violates these Terms or applicable law. Deleted content cannot be recovered.
4.1 Account Security
You are responsible for all activity that occurs under your account. We recommend using a strong, unique password and enabling any available security features. If you believe your account has been compromised, contact us immediately.
4.2 Account Termination and Data Deletion
You may request deletion of your account at any time by contacting our Privacy Officer. Upon receiving a deletion request, we will:
- Close your account and prevent further access
- Delete personal information not required for legal or regulatory purposes within 90 days
- Retain transaction records for 7 years as required by tax law
- Confirm completion of the deletion process via email
We may also terminate accounts that violate these Terms or remain inactive for an extended period, with reasonable notice where possible.
5. Products and Services
All goods displayed are subject to availability and may be modified or discontinued without notice. Certain products or Services may be available exclusively online and in limited quantities. The products offered are supplied or manufactured by third parties. We do not guarantee that products or Services will meet your expectations. We are not liable to you or any third party for any errors or defects. All purchases are made at your own risk.
6. Pricing, Orders, and Payments
Prices are displayed in Canadian dollars (CAD) and are subject to change without notice. We reserve the right to refuse, limit, cancel, or modify any order, including those that appear to be placed by resellers or distributors.
6.1 Accepted Payment Methods
We accept payment through PayPal, which allows you to pay using your PayPal balance, linked bank account, or credit/debit card. By submitting payment, you authorize PayPal to process the applicable amount. If a payment violates these Terms or applicable law, we may cancel or reverse the transaction.
6.2 Payment Processing
All payment transactions are processed entirely through PayPal. We do not collect, store, or have access to your credit card numbers, bank account details, or other payment credentials. Your payment information is handled according to PayPal’s Terms of Service and Privacy Policy, available at paypal.com.
6.4 Pre-Purchase Disclosure
Before completing any purchase, you will be provided with: a complete itemized summary of your order including all products, quantities, and prices; all applicable taxes and shipping charges; the expected delivery timeframe; and an opportunity to review and correct your order before final submission. You must expressly confirm your order before payment is processed.
7. Shipping and Delivery
We currently ship only within Ontario. Delivery methods are primarily Canada Post services or delivery using our own vehicles for local orders. Estimated delivery times are not guaranteed and exclude weekends and statutory holidays. Shipping charges are additional unless free shipping promotions apply.
At checkout, you can choose regular or expedited service. Canada Post estimated costs are provided.
You are responsible for providing complete and accurate delivery information. We are not liable for improper delivery caused by inaccurate or incomplete details.
7.1 Order Confirmation
Within 15 days of your purchase, you will receive written confirmation (via email) containing: your order details and itemized pricing; our business contact information; the delivery arrangement and expected delivery date; and a copy of our return and cancellation policies.
8. Returns, Refunds, and Cancellations
8.1 Cancellations
Orders may be canceled within 24 hours of purchase, provided they have not shipped. A 10% cancellation/restocking fee applies. Once shipped or after 24 hours, all sales are final except as outlined below.
8.2 Your Statutory Cancellation Rights
Under the Ontario Consumer Protection Act, 2002, you have the following cancellation rights that cannot be waived:
- 7 days to cancel if any required pre-purchase disclosures were missing or if you were not given an express opportunity to accept or decline the transaction
- 30 days to cancel if you do not receive written confirmation of your order within 15 days of purchase
- Cancel at any time if goods are not delivered within 30 days of the agreed or estimated delivery date, with entitlement to a full refund
To exercise these statutory rights, contact us in writing (email or mail) with your order details.
8.3 Refunds
For voluntary returns (outside of statutory cancellation rights), approved refunds are issued as in-store credit only. Refund requests must be made within one week of receipt of goods. Notice must be provided by email, documented telephone call, or in person.
Refunds are accepted only if the item is damaged or defective, the incorrect item was shipped, or the item is the wrong size.
Refunds for statutory cancellations will be processed within 15 days to your original payment method.
8.4 Returns
Returns must be unopened, unused, in original packaging, and free from damage. Returns may be made in person or by mail/courier at the customer’s expense. Products must be received at St. Lawrence Pools in saleable condition within 25 days of original receipt. Shipping costs are non-refundable.
8.5 Damaged or Incorrect Items
You must notify us promptly with supporting details and photos, if applicable. Replacement items will be shipped at no cost where approved.
8.6 Substitutions
We may substitute products of equal or greater quality or value without notice when necessary.
9. Warranties
All products are subject to the manufacturer’s warranty, if any.
9.1 Statutory Warranty Rights
Under Ontario’s Sale of Goods Act, consumer purchases include implied warranties that cannot be excluded, including: that goods will be of merchantable quality; that goods will be fit for the purpose for which they are sold; and that goods will correspond with their description. These statutory rights are in addition to any manufacturer warranty and remain in full effect regardless of any other terms stated herein.
Any attempt to exclude or limit these statutory warranties is void and unenforceable.

10.2 Information We Collect
We collect personal information necessary to process transactions, manage accounts, and provide Services, including: name; shipping and billing addresses; email address; telephone number; purchase history; IP address and device information; and website usage data through cookies and similar technologies.
Note: We do not collect or store your payment card details. All payment processing is handled directly by PayPal.
10.3 How We Use Your Information
Your information is used for: processing and fulfilling orders; managing your account; communicating about your orders and account; sending marketing communications (with your consent); improving our products, services, and website; fraud prevention and security; and compliance with legal obligations.
10.4 Third-Party Disclosure
We share your personal information only as necessary with: PayPal to process your payment (note: your payment information is provided directly to PayPal and is not shared with us); shipping providers (Canada Post, local delivery services) to deliver your orders; analytics providers to improve our services; and as required by law or to protect our legal rights.
Third-party service providers are governed by their own privacy policies and terms of service.
10.5 Data Processed Outside Canada
PayPal, our payment processor, is a US-based company. When you make a payment, your payment information is processed by PayPal according to their privacy policy and may be stored on servers located in the United States. 10.6 Data Security
We implement reasonable security measures to protect your personal information, including SSL/TLS encryption for data transmission, secure server infrastructure, access controls limiting employee access to personal information, and regular security assessments. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
10.7 Data Breach Notification
In the event of a security breach involving your personal information that creates a real risk of significant harm, we will notify you as soon as feasible with details of the breach, the information involved, steps we are taking, and steps you can take to protect yourself. We will also report such breaches to the Office of the Privacy Commissioner of Canada as required by PIPEDA. We maintain records of all breaches for a minimum of 24 months.
10.8 Your Privacy Rights
Under PIPEDA, you have the right to: request access to your personal information (we will respond within 30 days); request correction of inaccurate information; withdraw consent for collection, use, or disclosure (subject to legal requirements); and file a complaint with the Office of the Privacy Commissioner of Canada if you believe your privacy rights have been violated. We retain your personal information only as long as necessary for the purposes described in this policy or as required by law:

11. Email Marketing and Communications (CASL Compliance)
11.1 Marketing Consent
We will only send you commercial electronic messages (promotional emails, newsletters, special offers) if you have provided express consent. Marketing consent is separate from creating an account or agreeing to these Terms.
When you provide marketing consent, we will clearly identify St. Lawrence Pools (1995) Limited and HotTubGO as the sender; describe the types of messages you will receive; provide our mailing address and contact information; and explain that you may withdraw consent at any time.
11.2 Implied Consent
If you make a purchase, we may send you marketing emails for up to 2 years from your last purchase based on implied consent under CASL. If you create an account without making a purchase, implied consent lasts for 6 months.
11.3 Transactional Messages
Order confirmations, shipping notifications, account alerts, and other transactional messages do not require marketing consent and will not contain promotional content.
11.4 Unsubscribe Rights
Every marketing email includes an unsubscribe link. You may withdraw consent at any time by clicking the unsubscribe link (functional for at least 60 days after sending); contacting us by email, phone, or mail; or updating your preferences in your account settings. Unsubscribe requests are processed within 10 business days. You do not need to provide any personal information beyond your email address to unsubscribe.
11.5 Consent Records
We maintain records of your consent including the date, time, method, and specific consent language displayed, for at least 3 years after our business relationship ends.
12. Cookies and Tracking Technologies
12.1 What Are Cookies
Cookies are small text files placed on your device when you visit our Site. We use cookies and similar technologies to operate the Site, remember your preferences, and analyze usage.
12.2 Types of Cookies We Use
Essential Cookies: Required for Site functionality (shopping cart, checkout, account access). These cannot be disabled.
Analytics Cookies: Help us understand how visitors use our Site (e.g., Google Analytics). These collect anonymized data about pages visited, time spent, and navigation patterns.
Marketing Cookies: Used to deliver relevant advertisements and track campaign effectiveness. These are only placed with your consent.

14. Dispute Resolution and Complaints
14.1 Contact Us First
If you have a complaint or dispute regarding your order, our products, or our services, please contact us first. We are committed to resolving issues fairly and promptly.
14.2 Complaint Handling Process
We will acknowledge your complaint within 7 business days; investigate the matter and endeavor to resolve it within 45 days; keep you informed of progress if resolution takes longer; and maintain records of all complaints and resolutions.
14.3 Escalation
If you are not satisfied with our resolution, you may contact the Ontario Ministry of Public and Business Service Delivery (for consumer protection matters); the Office of the Privacy Commissioner of Canada (for privacy complaints); or pursue other remedies available under applicable law.
15. Limitation of Liability
To the maximum extent permitted by law, we disclaim all liability for any direct, indirect, incidental, consequential, or special damages arising from your use of the Site, Services, or products, including pain or suffering, loss of wages or income, loss of profits, data, or business interruption. Remedies are limited to repair, replacement, or refund of the original purchase price, at our discretion.
This limitation does not apply to liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or liability under the Consumer Protection Act, 2002, or the Sale of Goods Act.
16. Indemnification
You agree to indemnify and hold harmless St. Lawrence Pools (1995) Limited, HotTubGO, and their affiliates, officers, employees, and agents from any claims, losses, or expenses arising from your use of the Site or breach of these Terms.
17. Consumer Protection
Where applicable consumer protection legislation applies and cannot be excluded, your statutory rights remain unaffected. These Terms are subject to mandatory legal provisions. Nothing in these Terms is intended to limit or exclude rights that cannot be limited or excluded under the Ontario Consumer Protection Act, 2002, or other applicable consumer protection laws.
18. Accessibility
St. Lawrence Pools is committed to providing an accessible website and services for all customers, including those with disabilities. We strive to meet WCAG 2.0 Level AA accessibility standards in accordance with the Accessibility for Ontarians with Disabilities Act (AODA).

19. Governing Law and Severability
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Ontario.
If any provision is found invalid or unenforceable, the remaining provisions will remain in full force. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.
